Welcome to 春水Live ("we", "us", "our", the "Platform"). These Terms of Service (the "Terms") form a legally binding agreement between you and 春水Live governing your use of the Platform. Please read them carefully before use. Registering or continuing to use the Platform constitutes your acceptance of these Terms. If you do not agree, you must stop using the Platform.

These Terms should be read together with our Privacy Policy.

1. The Service

春水Live is an AI character interaction platform for adult users, offering:

• text-based chat with AI characters;
• creation, publication, and sharing of characters, Braindances (immersive scenarios), presets, and other content;
• community features (comments, likes, bookmarks, forums, group chats, etc.);
• paid features (top-ups, subscriptions, per-call AI model usage).

We may add, modify, suspend, or discontinue any feature at any time. Material changes will be communicated via in-platform notice or email.

2. Account & Security

You must provide truthful, accurate, and complete information when registering, and are responsible for all activity under your account. Keep your credentials secure; do not transfer, lend, or share your account. If you suspect unauthorized access, contact [email protected] immediately.

One natural person may register only one account. We may suspend or terminate accounts involved in violations, abuse, or security risks.

3. Age & Adult Content

The Platform is offered only to individuals who are 22 years of age or older and who have reached the age of majority in their jurisdiction. By registering you represent and warrant that you meet this requirement. If you are under 22, you must not register or use the Platform.

The Platform contains fictional content directed at adults that may include mature themes. All content is fictional and unrelated to real individuals. You are responsible for determining its suitability for you.

4. Acceptable Use

You agree not to use the Platform to:

• violate any applicable law, regulation, or third-party right;
• create or distribute child sexual abuse material (CSAM) or any sexualized content involving minors, including AI-generated content — this is an absolute prohibition;
• create non-consensual intimate imagery of real people, incite violence or terrorism, or promote self-harm;
• infringe others' copyrights, trademarks, image rights, privacy, or other lawful rights;
• harass, abuse, dox, stalk, or threaten others;
• use scrapers, automation, bots, or similar means to mass-extract or abuse Platform resources;
• circumvent or undermine our security, billing, moderation, or rate-limit mechanisms;
• distribute malware, phishing links, or commit fraud via the Platform;
• impersonate 春水Live staff, other users, or any third party.

Violations may result in content removal, account suspension, forfeiture of virtual assets, and — where serious — referral to competent authorities.

5. User Content & License

You retain copyright in the content you create or upload to the Platform (characters, Braindances, presets, comments, prompts, etc., "User Content"). You represent that you hold the necessary rights or authorizations for your User Content.

To operate, display, back up, and promote the Platform, you grant 春水Live a worldwide, non-exclusive, royalty-free, sublicensable license to store, reproduce, transmit, display, and adapt (e.g., to generate thumbnails or previews) your publicly published User Content within the Platform and related promotional contexts. The license persists while the content remains public; you may revoke it by removing public content, but lawful downstream uses already in effect (e.g., third-party fair use, backup copies) are not affected.

Private conversations between you and AI characters are not public by default; the license above applies only to content you actively share.

6. AI Output

Conversations, images, and text generated by AI models ("AI Output") are produced by probabilistic algorithms operated by model providers and do not constitute statements of fact, professional advice, or medical, legal, or financial counsel. AI Output may contain errors, biases, or fabrications. You must evaluate it independently and bear the consequences of your use.

You may not use AI Output for purposes prohibited under Section 4. You are responsible for assessing copyright and liability for any works you derive from AI Output.

7. Payments, Virtual Assets & Refunds

The Platform offers top-ups, subscriptions, and per-call billing. Prices shown at checkout are authoritative; the payment currency and method are governed by your chosen payment provider.

Virtual assets obtained through top-ups (e.g., petals, amber, subscription benefits) are usable only within the Platform. They are not redeemable for fiat currency, not transferable, not inheritable, and are forfeited upon account closure or suspension.

Except as required by law, consumed virtual assets and used subscription periods are non-refundable. If you dispute a charge, contact [email protected] within 7 days and we will review based on transaction records.

Subscriptions auto-renew at the end of each period by default. You may cancel at any time in account settings; cancellation takes effect at the end of the current period.

8. Intellectual Property

The software, interface design, trademarks, logos, copy, and model integrations of the Platform are the intellectual property of 春水Live or its licensors. You may not copy, modify, distribute, reverse engineer, or use them commercially without our written permission.

Third-party AI models, fonts, and open-source components are governed by their respective licenses.

9. Disclaimer

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we make no warranties of any kind, express or implied, including without limitation merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or freedom from error. We do not warrant the accuracy, completeness, or suitability of AI Output, nor are we responsible for the availability or quality of third-party model providers.

10. Limitation of Liability

To the maximum extent permitted by applicable law, 春水Live is not liable for any indirect, incidental, special, punitive, or consequential damages (including loss of profits, loss of data, or reputational harm) arising out of or relating to your use of, or inability to use, the Platform.

In no event shall 春水Live's aggregate liability to you exceed the greater of (a) the total fees you actually paid to the Platform in the 12 months preceding the event giving rise to the claim, or (b) RMB 100.

11. Termination

You may close your account at any time in account settings (see the Privacy Policy). We may suspend or terminate your account for breach of these Terms, prolonged inactivity, or legal/compliance reasons, with reasonable prior notice where practicable.

Sections 5, 6, 8, 9, 10, 13, and any other provisions which by their nature should survive, will survive termination.

12. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated via in-platform notice or email before they take effect, and the "Effective" date above will be updated. Continued use after the effective date constitutes acceptance. If you do not agree, you may stop using the Platform and close your account before the change takes effect.

13. Governing Law & Disputes

These Terms are governed by the laws of the People's Republic of China (excluding conflict-of-laws rules and the laws of Hong Kong, Macau, and Taiwan).

Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. Failing that, either party may bring suit before a competent People's Court in the principal place of business of 春水Live.
